CCPA Notice for California Residents

This CCPA Notice for California Residents (the “Notice”) supplements the information contained in the Varian Medical Systems Privacy Statement (the “Privacy Policy”) and applies solely to visitors, users, and others who reside in the State of California (“you,” “your”) who visit our sites, content, applications, services, tools and features, provided by Varian Medical Systems, Inc., a Siemens Healthineers company (including its affiliate entities, collectively, "Varian," “We”) (collectively, the “Services”). Capitalized terms not defined in the Notice have the same meaning as in the CCPA, or otherwise in our Privacy Policy. This Notice does not apply to “protected health information” or “PHI” that is governed by the Health Insurance Portability and Accountability Act of 1996, as amended by the Health Information Technology for Economic and Clinical Health Act, and all regulations promulgated thereunder (“HIPAA”) or “medical information” or “Med Info” that is governed by the California Confidentiality of Medical Information Act (“CMIA”).

INFORMATION OF CALIFORNIA RESIDENTS THAT WE COLLECT, AND HOW WE USE AND SHARE SUCH INFORMATION

In the chart below, we have described the categories of Personal Information that we have collected and shared over the past twelve (12) months, the purposes for such collection and the types of entities with whom we have shared such information.

The Company does not, and during the past twelve (12) months did not, “sell” personal information of California residents (as such term is defined in the CCPA).

Your Rights and Choices

California residents have the following rights under the CCPA:

  • Right to Know
    You have the right to request that we disclose to you the Personal Information that we maintain about you, which we will provide to you upon receipt of a verifiable request (see further info below on how to submit such requests, in “Exercising Your Rights”).
  • Right to Delete
    You have the right to request that Varian delete any of your Personal Information that we have collected from you.
  • Right to Nondiscrimination
    You have the right not to receive discriminatory treatment for the exercise of your privacy rights under the CCPA. We will not discriminate against you for exercising any of your CCPA rights.

Further, under the California “Shine the Light Law,” California residents have the right to request certain details about how their “personal information” (as defined in Cal. Civil Code § 1798.83) is shared with third parties for direct marketing purposes. To the extent we have shared personal information in this way, California users may, under certain circumstances, request and obtain certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us using the information listed below. Please note that we are only required to respond to one request relating to direct marketing purposes per California resident each year.

Exercising Your Rights

To exercise one of the above rights, please submit a request using our contact information below.

  • Only you, or someone that you authorize to act on your behalf, may make a request related to your Personal Information. An authorized agent may make a request on your behalf by providing written permission signed by you.
  • We will need to confirm your identity or the identity of your authorized agent, before processing your request by asking you to log into your existing account (if you are a registered user) or by asking you for additional information, such as a government issued ID, to confirm your identity against information we have already collected.
  • Please note that you may only make a request for access twice within a 12-month period.
